Offenders who have no assets to pay a fine may be ordered to do a certain amount of community work under a work and development order.
In order to convert an unpaid fine to a work and development order, a number of conditons must be met:
- the fine must have been imposed in a court and have been referred to the Fines Enforcement Registry for enforcement as a result of not being paid;
- the offender has no motor vehicle driver's licence or vehicle registration to suspend; and
- the Sheriff is unable to size goods or property and has issued an order to attend for work and development.
The order includes:
- six hours work will be done for each $150 which has not been paid, or part thereof;
- six hours is the minimum work period;
- if more than 12 hours work is required, the minimum weekly hours will be 12; and
- you can pay out the balance of a fine during a work order. The balance must be paid in full as per the payout letter from the Community-Based Services centre being attended.
Failure to perform the required hours of work may result in cancellation of the order and imprisonment to serve the balance of the unpaid fine in default.
