For a young person aged 10 - 17 to get bail, a responsible adult must sign the undertaking to make sure the promise is kept. A responsible adult can be dad or mum, a relative, boss or anyone the police or magistrate thinks can help look after and supervise the juvenile - encouraging them not to commit further crime while waiting for their court date.
The supervised bail program is available for juveniles when a responsible adult can't be found to sign the bail undertaking.
However, not all juveniles charged with an offence are granted bail by the courts. If this is the case, they will be remanded in custody to the Rangeview Remand Centre.
Special staff called bail coordinators or liaison officers (meaning people who act as go-betweens) at the Children's Court and Rangeview Remand Centre can help find a responsible adult to sign the bail undertaking. The bail coordinator can sometimes act as a responsible adult, though only when there is no one else is available.
A juvenile cannot be released on bail if:
- there is nowhere for the young person to stay
- he or she is considered a risk to other people or themselves
- he or she has committed a serious offence whilst on bail.
Once given bail, the juvenile will be helped by a bail coordinator to make sure they follow the conditions. If they don't, bail is cancelled and the juvenile is detained.
